2.3.6 Compliance

Dual Approval Framework

Most building or land-use change at Lake Bennett requires both:

  1. Planning / development consent under the Lake Bennett locality provisions (Schedule 5) and any Development Permit (e.g. DP04/0022 / Schedule 6 for Section 1252).
  2. Corporation approval of plans and specifications before improvements commence (Articles 5.1) — in addition to local/Territory authority requirements.
  3. Building certification — Lake Bennett is a Tier 1 Building Control Area (full NCC / occupancy certification). See 2.3.4 Development Controls.

Development Approvals

  • Use/development expressly permitted without consent only if it complies with all relevant clauses.
  • Non-compliance with one or more relevant clauses requires consent.
  • Uses not described in Part 2 specific land-use controls are prohibited.
  • Consent authority may vary performance criteria for special circumstances, or require a higher standard.

Section 1252 (units plan)

  • With consent only: condominium development, maximum 64 dwellings, single storey, lake-protection and livestock conditions (Schedule 5, clause 12).
  • New dwellings: style, separation, setbacks, flood level, A/C screening, connection to effluent and potable water, easement compliance (Schedule 6 / DP04/0022). Detail: 2.3.1 Zoning Overview.

Corporation Process (Articles 5)

  • Submit plans and specifications (including landscaping plan) to the Corporation before starting work.
  • Improvements that infringe covenants must be removed at the proprietor’s expense.

  • Impact on the lake; suitability of land (visual and environmental); adequacy of water, sewerage, electricity and roads (Schedule 5, clause 8).

Enforcement

Corporation Inspection and Entry

  • Authorised agents may inspect units for compliance with the Act and Articles, and carry out corporation maintenance/duties, on reasonable notice — or without notice in an emergency (Articles 2.1–2.2).

Rectification

  • Non-compliant improvements: remove at proprietor’s expense (Articles 5.1).
  • Proprietors must comply with NT law requiring repairs or works on their unit (Articles 4.2).

  • Corporation decisions: raise with committee / AGM; strata advice via Whittles portal.
